Florida Overweight Container Permits and Triaxle Chassis Limits

If you move ocean containers in and out of South Florida, you have almost certainly had this conversation: the container weighs 38,000 pounds, the driver says he needs an overweight permit, and the shipper insists the load is “legal” because it was legal on the vessel. Both people are right about different things, and the gap between them is where detention, fines, and blown delivery appointments live.

This guide explains how container weight actually works on Florida roads, when you need an overweight permit, what a triaxle chassis does and doesn’t solve, and how to price a heavy container move before you accept it.

Why a “legal” container is often an illegal truck

Ocean carriers rate containers by cargo weight. Highways regulate the entire vehicle. Those are two different numbers, and the second one is bigger.

A loaded 20-foot container carrying 38,000 pounds of cargo is unremarkable at sea. Put it on a chassis behind a tractor and you are now weighing cargo, plus the container tare (roughly 4,800-5,200 lbs for a standard 20′), plus the chassis (roughly 6,500-8,000 lbs depending on type), plus the tractor (roughly 17,000-19,000 lbs). That arithmetic lands you well over the 80,000-pound federal gross vehicle weight limit on the Interstate system.

The trap is that gross weight is not the only constraint. Axle weight and axle spacing matter just as much, and a 20-foot container is the worst case: all that cargo weight sits in a short wheelbase, concentrating load on the tandems instead of spreading it across the vehicle. You can be under 80,000 pounds gross and still be illegal on the drive or trailer axles.

The three numbers that decide the move

Because the limits differ between the Interstate system, state highways, and county roads, the same container can be legal for one routing and illegal for another. That is not a technicality – it is the entire reason permitted heavy moves are routed the way they are.

What a triaxle chassis actually buys you

A standard chassis has two axles at the rear. A triaxle has three. The third axle spreads the load across a wider group, which raises the legal weight that group can carry under the bridge formula.

Two things people get wrong about triaxles:

1. A triaxle is not a permit substitute

A triaxle raises your axle allowance. It does not raise the gross vehicle weight ceiling. If your total gross is over the limit, you still need a permit – the triaxle just makes the permitted configuration achievable.

2. Triaxle chassis are a scarce, priced resource

Most chassis in a pool are standard two-axle units. Triaxles are a smaller subset, they cost more per day, and in a tight week you may not get one at all. If your quote assumed a triaxle and the pool is out, your options are to wait, to transload, or to eat the cost. Build that risk into the rate, not into your margin.

When you need an overweight permit

In practical terms, you are in permit territory when the combined weight of tractor, chassis, container, and cargo exceeds the legal gross or axle limits for the roads on your route. For a 20-foot container, that threshold arrives much earlier than shippers expect – heavy commodities like tile, stone, beverages, machinery parts, and liquids in flexitanks routinely cross it.

Permits are typically issued as either single-trip (one move, one route, one date range) or blanket/annual (repeat moves within defined parameters). Single-trip permits are the norm for one-off port moves. Annual permits make sense when you are running the same heavy lane repeatedly and can justify the administrative overhead.

Permit rules, fee schedules, and route restrictions are set by the state and can change. Before you quote a heavy move, confirm current requirements with the Florida Department of Transportation’s permit office rather than relying on what was true last year.

How to quote a heavy container without losing money

Heavy drayage is where thin quotes go to die. Price the whole move, not the linehaul:

The single most expensive mistake is discovering the weight at the terminal gate. At that point the driver is already on the clock, the appointment is burning, and you are negotiating from zero leverage. Get the verified gross mass from the ocean carrier’s documentation before you dispatch, not after.

The transload alternative

When a container is heavy enough that permits and triaxles start stacking up, run the math on transloading instead. Stripping the container at a warehouse near the port and reloading into a domestic 53-foot trailer eliminates the overweight problem entirely, releases the container back to the terminal faster, and stops the per-diem clock. Whether it wins depends on your inland distance – transload costs are fixed, permit costs scale with the move. Past roughly a few hundred miles inland, transloading usually wins.

The compliance side nobody enjoys

Running overweight without a permit is not a paperwork problem. It exposes the carrier to fines that scale with the amount of overage, puts the driver’s record at risk, and creates a liability problem if anything goes wrong in transit. It also damages equipment – brakes, tires, and chassis components wear differently under sustained overload, and that bill arrives later.

If you are the shipper or the broker, understand that asking a carrier to “just run it” is asking them to absorb a risk you are not paying for. The professional move is to identify the weight early, permit it properly, and charge for it.

A short checklist before you dispatch a heavy container

  1. Pull the verified gross mass from the ocean carrier documentation.
  2. Add tractor and chassis tare to get an honest estimated gross.
  3. Compare against gross and axle limits for the actual route, not just the Interstate figure.
  4. Confirm triaxle availability before you commit to a delivery window.
  5. Apply for the permit with enough lead time that it does not become the reason you miss the appointment.
  6. Compare the fully loaded permitted cost against a transload scenario.

Do those six things and heavy containers stop being a source of surprise costs and become a lane you can actually price with confidence.
